Terms and Conditions

1. Agreement to Terms

By purchasing any original painting from this site, the purchaser agrees to be bound by these terms and conditions.

2. Original Artwork

All paintings sold are unique, original works of art. As such, slight variations in color or texture may occur between the original works and this representation on this website due to lighting and screen calibration.

3. Payment

Full payment (other than shipping costs) is required at the time of purchase. All prices are listed in GBP. Payment must be made in GBP.

4. Shipping

Shipping note: Due to current international logistics, shipping costs are not included at checkout. A separate invoice for shipping which will include insurance and packaging is calculated based on destination and current carrier rates and will be sent to you via email within 2 business days of your purchase. The purchaser is responsible for any import duties and local taxes.

5. Delivery & Handling

Artworks will be shipped only after the shipping invoice has been paid in full. Packaging standards are maintained to ensure as far as reasonably possible the safety of the piece during transit.

6. Returns & Refunds

Due to the delicate nature of original artwork, all sales are final. Refunds or exchanges are not accepted unless the item arrives damaged at the designated address. The artist’s liability in the event of damage or loss is limited to the original purchase price. Refunds of the original purchase price will be made in GBP. In the event of damage during transit, the purchaser is required to contact the artist within 48 hours of receipt with photographic evidence of the damage. The artwork must be retained by the purchaser until notified otherwise for insurance purposes and the artist retains the right to require the artwork to be returned.

7. Intellectual Property

The purchase of an original painting does not transfer copyright or reproduction rights, the purchaser acquires physical ownership of the artwork only. The artist retains all rights to reproduce the image for promotional or commercial purposes.

8. Returns and Cancellations

If the purchaser is an individual acting as a consumer residing in the UK or the EU they have the right to cancel the contract within 14 days of receiving the artwork subject to the following.

The purchaser must notify the artist in writing within 14 days of receipt

The artwork must be returned and received in its original undamaged condition.

The purchaser is responsible for the cost of return shipping and must use a trackable, insured courier service. Details of the shipping and insurance must be provided to the artist. The purchaser nevertheless remains liable for the artwork until it is received in its original condition.

The purchaser will forfeit the total amount paid if the artwork is not received in its original condition and must rely on its insurance for recovery of amounts paid.

9.Governing Law

This agreement shall be governed by and construed in accordance with the laws of England and Wales and subject to the jurisdiction of the English courts.
